1. Agreement To Terms

These Terms of Service (“Terms”) govern your access to and use of the Lone Star ABA Services LLC (“Lone Star ABA,” “we,” “our,” “us”) website at www.lonestaraba.com and related services. By using the website, you agree to these Terms. If you do not agree, please do not use the site.

2. Not Medical Or Legal Advice

The content on this website is provided for general informational purposes only. It is notintended to be a substitute for professional medical, clinical, psychological, or legal advice, diagnosis, or treatment. Always seek the advice of a qualified licensed provider with any questions you may have about a medical condition or a child’s behavior. Nothing on this site creates a therapist-client or BCBA-client relationship between you and Lone Star ABA. Such a relationship is formed only upon execution of written service agreements.

3. Incorporated Documents

The following documents are incorporated into these Terms by reference and form part of your agreement with us:

  • Privacy Policy — how we handle information collected through this website.
  • Accessibility Statement — our commitments and how to request accommodations.
  • For patients only, the separately provided Notice of Privacy Practices, Service Delivery Agreement, and Consent to Telehealth, which govern the provider-patient relationship.

4. Telehealth Services — Texas Only

Lone Star ABA is licensed to provide Applied Behavior Analysis (ABA) clinical services only to individuals physically located in the State of Texas at the time of service. We do not provide clinical services to residents of other states or to individuals located outside Texas, regardless of where they reside.

Information available on this website is informational only and does not constitute the practice of behavior analysis, psychology, medicine, or any regulated healthcare service in any jurisdiction. Clinical services are subject to licensure, insurance, state, and federal rules governing the practice of applied behavior analysis and telehealth delivery in Texas.

A separate Service Delivery Agreement, Consent to Telehealth, and Notice of Privacy Practices are provided to patients at intake and govern the provider-patient relationship. These Terms do not create that relationship.

5. Eligibility

You must be at least 18 years of age, or the parent, legal guardian, or authorized caregiver of a minor, to submit information or request services through this website. We do not knowingly permit minors to create accounts or submit information directly through this site. If you believe a minor has submitted information without parental or guardian consent, please contact us so we can remove it. Our handling of minors’ information is also governed by our Privacy Policy and the Texas Securing Children Online through Parental Empowerment Act.

6. Acceptable Use

You agree not to:

  • Use the website for any unlawful purpose or in violation of any law.
  • Submit false, misleading, or fraudulent information.
  • Attempt to gain unauthorized access to any portion of the site, our systems, or other users’ data.
  • Upload or transmit viruses, malware, or other harmful code.
  • Scrape, spider, or otherwise extract data from the site without prior written consent.
  • Interfere with the operation or security of the site.

7. Electronic Communications

By using this website or providing your email address or phone number, you consent to receive communications from us electronically. This consent applies to website-related communications; clinical communications are governed by the separate Consent to Telehealth provided at intake.

All content on this website, including text, graphics, logos, icons, images, and the arrangement thereof (the “Content”), is owned by Lone Star ABA Services LLC or its licensors and is protected by U.S. and international copyright, trademark, and other laws. You may view and use the Content solely for your personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, or publicly display the Content without our prior written permission.

9. Third-Party Links

Our website may contain links to third-party websites or services that are not owned or controlled by Lone Star ABA. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites. You access such sites at your own risk.

10. User-Submitted Information

If you submit information through our contact or intake forms, you represent that the information is accurate, that you have the authority to share it, and that doing so does not violate any third-party rights. Do not submit sensitive medical information through unsecured channels; use the designated secure intake methods we direct you to.

11. Disclaimer Of Warranties

The website is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or non-interruption. Lone Star ABA does not warrant that the site will be error-free, secure, or continuously available.

12. Limitation Of Liability

This section applies only to your use of this website and not to the provision of clinical services, which are governed by separate written agreements.

To the fullest extent permitted by law, Lone Star ABA, its officers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your access to or use of this website. Our total cumulative liability for any claim arising from or related to your use of this website shall not exceed one hundred U.S. dollars ($100).

The limitations above do not apply to, and nothing in these Terms limits or excludes:

  • Liability for death or personal injury caused by our negligence.
  • Liability for gross negligence, willful misconduct, or fraud.
  • Liability for violations of the Health Insurance Portability and Accountability Act (HIPAA), the Texas Medical Records Privacy Act (HB 300), or any other applicable state or federal privacy law.
  • Any other liability that cannot be limited or excluded under applicable Texas or federal law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Lone Star ABA and its officers, employees, contractors, and affiliates from any third-party claim, demand, loss, or damages (including reasonable attorneys’ fees) arising out of: (a) your violation of these Terms; (b) your violation of any law or third-party right; or (c) any false, misleading, or fraudulent information you submit through the website. This indemnification obligation does notextend to claims caused by Lone Star ABA’s own negligence, gross negligence, or willful misconduct.

14. Governing Law; Venue

Informal resolution first. Before filing any claim arising out of or relating to these Terms or the website, you agree to first contact us at info@lonestaraba.com and give us thirty (30) days to resolve the dispute informally and in good faith.

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the website shall be brought exclusively in the state or federal courts located in Burnet County, Texas, and you consent to the personal jurisdiction and venue of such courts.

15. Changes To These Terms

We may modify these Terms at any time. Changes are effective when posted, and your continued use of the website constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

17. Force Majeure

Lone Star ABA shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, severe weather, pandemic or public health emergency, war, terrorism, civil unrest, cyberattack, power or telecommunications failure, internet service interruption, or any act or omission of a third-party service provider.

18. General

Entire Agreement. These Terms, together with the documents incorporated by reference, constitute the entire agreement between you and Lone Star ABA regarding your use of this website and supersede all prior agreements on that subject.

No Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. A waiver of any provision is effective only if in writing and signed by an authorized representative of Lone Star ABA.

Assignment. You may not assign or transfer these Terms or any of your rights or obligations without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition, sale of assets, or by operation of law.

Survival. Sections relating to Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law and Venue, and this General section survive any termination of your use of the website.
